The petitioner seeks bail in a case instituted under Section 302/34 of the Indian Penal Code.

It is alleged by the informant, Shital Khairwar that on 13.1.2015 his son Nuneshwar, who was dealing in fish business, went out of the house stating that the petitioner Ashok Yadav has called him to take his money. Subsequently, the beheaded dead body of the son of the informant was recovered from the Binjha forest and his head and cycle from Naika Kuan and suspicion was raised against the petitioner, Ashok Yadav, coaccused Dharo Yadav and Shubho Yadav of killing the deceased. The petitioner is in custody since 19.1.2015 and

Patna High Court Cr.Misc. No.25002 of 2015 (2) dt.20-07-2015 2/2 charge sheet has already been submitted in the case. It is further submitted that the petitioner is named in the FIR merely on suspicion and there is no direct or indirect evidence to suggest involvement of the petitioner in the present case. It is further submitted that co-accused Shubho Yadav has been granted bail by this Court in Cr. Misc. No. 22830 of 2015. On behalf of the State it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Amit Kumar Singh, J.M.1st. Class, Jamui in connection with Sikandara P.S. Case No. 07 of 2015. (Sudhir Singh, J) S.Pandey/- U T
