2. The petitioner seeks regular bail in connection with Bairiya P.S. Case No. 268 of 2024 registered for the offence under Sections 137(2) & 96 read with 3(5) of the BNS, 2023.
3. As per the prosecution case, petitioner is accused of kidnapping the victim girl.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. He further submits that the petitioner has falsely been implicated in this case and is in custody since 29.09.2024

5. Learned counsel for the informant has vehemently opposed the prayer for bail.
6. From the statement of the victim girl it appears that she had herself left the house as she was in relationship with the petitioner.
7. Considering the facts and circumstances of the case as well as the statement of the victim girl, this application for regular bail is allowed.
8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VII-cum-Special Judge (POCSO), West Champaran at Bettiah/concerned Court below in connection with Bairiya P.S. Case No. 268 of 2024.
