JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is in custody since 19.3.2015 in Patrakar Nagar P.S. Case no.75/15 for the offence under Section 376 of the I.P.C. and Section 12 of the Protection of Children from Sexual Offence Act.

The prosecution case, in brief, is that the petitioner came in contact with the victim girl since December, 2014 and established physical relationship with her on the pretext of marriage with her and when she became pregnant he began evading from her. He used to take money from her but he denied to keep her.

On behalf of the petitioner, it has been submitted that he is in custody since 19.3.2015 and charge sheet has already been submitted. It is further submitted that the petitioner has been

On behalf of the State it is submitted that there is specific allegation against the petitioner is of committing rape on the victim girl on the pretext of marriage.

Considering the aforesaid facts and circumstances, let the petitioner, above named, after remaining eight months in custody since 19.3.2015, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge POCSO, Patna, in Special (POCSO) Case No.42/15 arising out of Patrakar Nagar P.S. Case No.75/15.
