JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-01-2019 The petitioner seeks bail in anticipation of his arrest in connection with Hisua P.S. Case No. 254 of 2018 dated 02.09.2018 instituted for the offences under Sections 341, 323, 379, 504, 506, 307, 34 of the Indian Penal Code. The petitioner is alleged to have waylaid the informant and assaulted him by means of bricks and hard blunt substances.

The learned counsel for the petitioner has submitted that the dispute lies somewhere else. The simple injury which has been received by the informant has not been caused in the course of the so called attack by the petitioner but because of the informant having fallen down

The petitioner does not have criminal antecedents. Regard being had to the aforesaid facts, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Nawada in connection with Hisua P.S. Case No. 254 of 2018, ssubject to the conditions as laid down under Section 438(2) of the Cr.P.C.
