Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 376 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a woman aged about 21 years and the informant alleges that petitioner on 16-12-2023 called her at her home from where her brother kidnapped her and took her to Jaipur and established physical relations.

Learned counsel for the petitioner next submits that the date of occurrence is 16-12-2023 and the FIR came to instituted on 10-1-2024, i.e., is after a delay of more than 23
Patna High Court CR. MISC. No.4157 of 2025(4) dt.09-05-2025 2/2 days. It is further submitted that it absolutely does not stand to reason that how offence of kidnapping is made out when the victim herself is the informant, which amply demonstrates that the victim on her own volition left with the brother of the petitioner and falsely implicated the petitioner. 5.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bajpatti P.S. Case No. 13 of 2024, subject to the conditions as laid down under Section 482 (2) of the BNSS.
