The petitioner seeks bail in connection with Sessions Trial No. 282 of 2014 arising out of Nawanagar P.S. Case No.80 of 2014 registered for the offences punishable under sections 384, 386, 414 read with 34 of the Indian Penal Code, 16, 17, 18, 20 of the Unlawful Activities (Prevention) Act and 17 of the C.L.A. Act. It has been contended that co-accused Binod Paswan against whom identical allegations have been made in the FIR has already been granted bail by a Bench of this Court vide order dated 26.9.2014 passed in Cr. Misc. No.33477 of 2014. It has further been contended that, by now, the petitioner is in custody for over one year and there is no progress in trial. Learned counsel for the State does not dispute the fact
Patna High Court Cr.Misc. No.18355 of 2015 (2) dt.20-05-2015 2/2 that the case of the petitioner stands on identical footing to that of Binod Paswan, who has already been granted bail by this Court. Regard being had to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J.-VI, Buxar in connection with Sessions Trial No.282 of 2014 arising out of Nawanagar P.S. Case No.80 of 2014.
