JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 10.03.2016 in a case registered for the offences punishable under Sections 22 and 24 of the Indian Penal Code.
From the possession of the petitioner, 100 grams ganja like material were recovered.
It is submitted by learned counsel for the petitioner that recovery of contraband is of marginal quantity. Though, the petitioner is accused in one other case also but the same is not registered under the provisions of NDPS Act and in that case the petitioner is on bail.
Considering the quantity of recovery, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each
Patna High Court Cr.Misc. No.15801 of 2016 (2) dt.08-04-2016 2/2 to the satisfaction of learned Sessions Judge/Special Judge, East Champaran, Motihari in connection with NDPS Case No. 17 of 2016 arising out of Pipra Kothi P.S. Case No. 22 of 2016. The bail bond of the petitioner shall be accepted on filing of the affidavit by the petitioner before the learned court below to the effect that he will regularly co-operate in the investigation. Non-co-operation in the investigation by the petitioner will give liberty to the learned court below to cancel the bail bonds of the petitioner. The bail bonds of the petitioner will also be cancelled if he gets involved in similar nature of offence. (Dinesh Kumar Singh, J) Amrendra/- U T
