JUSTICE BIRENDRA KUMAR ORAL ORDER 16-04-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is languishing in custody for the offence punishable under Section 304B/34 of the Indian Penal Code in connection with S.T. No.155 of 2018, arising out of Manjhagarh P.S. Case No. 158 of 2017.

Petitioner is husband of the victim of dowry death. Marriage was solemnized in November, 2016. There is allegation of demand of dowry and torture for the same. The report of the learned trial Judge would reveal that out of ten, four prosecution witnesses have already been examined. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail for the present.
