1. Heard learned counsel for the petitioner and learned APP for the State.
2. Petitioner seeks regular bail in connection with Kudhani (Turki O.P) P.S. Case No. 493 of 2022, dated 11.10.2022 registered for the offences punishable under Sections 272, 273, 414, 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.
3. The main submissions advanced by petitioner's counsel are that the instant matter relates to the recovery of total 600 Liters of country-made foreign liquor and the same is stated to be recovered from two vehicles which were found to be parked in the premises of the house of co-accused Murari Singh and the brother of the said co-accused has also been made accused who has been granted anticipatory bail by this Court
Patna High Court CR. MISC. No.4868 of 2023(2) dt.29-04-2023 2/2 vide order passed in Cr. Misc. No. 8234 of 2023 and at the time of raid the petitioner was passing nearby the place of recovery and he was apprehended merely on suspicion and he has been languishing in jail since 12.10.2022 having fair and clean antecedent and the police have not made any independent witness of the search and seizure.
4. Learned APP appearing for the State has opposed the prayer for bail.

Considering the above submissions and mainly the petitioner's fair and clean antecedent and his custody period and also the fact that one named co-accused is on bail, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Kudhani (Turki O.P) P.S. Case No. 493 of 2022.
