JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The informant claims that petitioner and two others assaulted the deceased by sharp cutting weapon as well as hard and blunt substance but the post mortem report of the deceased tells different story because no injury, said to be caused by sharp cutting weapon, was found on the person of the deceased. Learned Additional Public Prosecutor appearing for the State points out that petitioner demanded extortion money from the deceased and when his demand was not fulfilled, he along with his associates committed the alleged crime and apart from this, petitioner carries criminal antecedent of near about 22 cases of serious nature.

No.16096 of 2016 (2) dt.21-04-2016 2/2 On the other hand, learned counsel appearing for the petitioner submits that having similar allegation, one co-accused, namely, Raj Babu Rai @ Raja Babu, has already been granted privilege of bail by this Court. It is further submitted that so far as the criminal antecedent of the petitioner is concerned, he has already been acquitted in near about 11 cases and in other cases, he is on bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that having more or less similar allegation, one co-accused has already been granted privilege of bail by this Court, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of District & Sessions Judge, Vaishali at Hajipur in connection with Bidupur P.S.Case No. 146 of 2014/Sessions Trial No.393 of 2015.
