The petitioner seeks regular bail in connection with Pandarak P. S. Case No. 101 of 2018 registered for offences punishable under Section 379 of the Indian Penal Code. Allegation is stealing of truck of informant as against unknown.

It has been submitted on behalf of the petitioner that nothing has been recovered from his possession and he has been made accused in this case on the basis of his confession and has been remanded in this case on 17.11.2018. It has further been submitted that the similarly situated co-accused person has been granted bail by a co-ordinate Bench of this Court vide order dated 17.01.2019 passed in Cr. Misc. No.900 of 2019.

No.4364 of 2019(2) dt.28-01-2019 2/2 Considering the facts and circumstances and the materials on record, let the petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna in connection with Pandarak P.S.Case No. 101 of 2018 subject to the following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

ii) The petitioner will not induce any witness or tamper with the evidence.

iii) The petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and his/her absence on two consecutive dates without sufficient reason his/her bail bond shall be cancelled by the court below.
