JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is languishing in custody since 11.12.2014 in connection with Durgawati P.S. Case No. 35 of 2014 for the offences instituted under Section 394 of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the informant being a truck driver was going to Asansol with truck when some miscreants assaulted the informant and snatched Rs. 3000/- and also fired as a result of which, he sustained injury in his thigh. Thereafter they fled away.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.12.2014 and the charge sheet has already been submitted in the present case. It is further submitted

Patna High Court Cr.Misc. No.25971 of 2015 (2) dt.23-07-2015 2/2 that the petitioner is not named in the F.I.R. nor the petitioner has been put on T.I.P. so as to ascertain his involvement in the present case.

On behalf of the State it has been submitted that the petitioner's name has come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabua, in connection with Durgawati P.S.
