The petitioner is apprehending his arrest in connection with Bheldi P.S. Case No. 235/2022, registered for the offence punishable under Sections 08, 20(b) (ii) (C) and 29 of the Narcotic Drugs and Psychotropic Substances Act pending in the learned court below.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, if the petitioner surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. MISC. No.5166 of 2023(2) dt.07-04-2023 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order considering this fact that no any contaminated article has been recovered from the conscious possession of the petitioner.
