JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-02-2019 This is an application for grant of anticipatory bail in connection with Udwant Nagar P.S. Case No. 224 of 2018, disclosing offences under Sections 420, 409 of the Indian Penal Code.

Allegation against the petitioner is of embezzlement of money granted for the construction in the school and the petitioner happens to be the Incharge Head Master. Submission of learned counsel for the petitioner is that the allotment was with respect to of Rs.11,52,000/- and he has completed the work of about Rs.8,73,323/- and Rs.2,78,667/- was remained, but later on he has completed the work and the Junior Engineer has given certificate to that extent. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and

No.10916 of 2019(2) dt.22-02-2019 2/2 circumstances of the case, this application is disposed of with a direction to the petitioner to surrender before the court below within a period of six weeks from the date of receipt of the order and produce all papers before the court below and the court below shall examine the veracity of the documents and in the meantime, the court below shall release the petitioner on provisional bail to his own satisfaction and once the veracity of the completion of work is obtained, the provisional bail of the petitioner shall be confirmed by the court below, otherwise he shall free to pass any order or orders as he deems fit and proper. With the above direction, this application is disposed of.
