The petitioner seeks bail in Jogbani (Bathnaha) P.S. Case No. 192 of 2021, registered for the offence punishable under Sections 392/411 of the Indian Penal Code. As per the prosecution case, this petitioner was nabbed by the police while taking away looted motorcycle of the informant.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case merely on suspicion. Nothing has been recovered from his conscious possession. Petitioner is in custody since 02.09.2021. Learned APP however, vehemently opposed the

Patna High Court CR. MISC. No.5323 of 2022(2) dt.04-04-2022 2/2 prayer for bail and submitted that petitioner has been apprehended with stolen motorcycle of informant and he has got six criminal antecedents.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
