JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Kotwali P.S. Case No. 419 of 2019 registered for the offences punishable under Sections 406, 420, 467, 468, 471 of the Indian Penal Code.
The accusation against the petitioner is that he got job of teacher by producing fake certificates.
However, submission on behalf of the petitioner is that petitioner has already been terminated from the service and having more or less similar allegation, several persons in different criminal cases have already been granted privilege of anticipatory bail by different Benches of this court. Patna High Court CR. MISC. No.2864 of 2020(2) dt.28-02-2020 2/2 submits that petitioner does not have any criminal antecedent which is evident from perusal of para 3 of the petition. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in Kotwali P.S. Case No. 419 of 2019, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
