Petitioner seeks bail in a case registered under section 307 /34 of the Indian Penal Code as well as section 27 of the Arms Act. Petitioner is named in the first information report but according to the prosecution case itself, it was co- accused Kishor Ram who opened fire on the informant and the petitioner is said to be only member of unlawful assembly.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in Ahiyapur P.S.
