The petitioner seeks bail in a case registered for the offence punishable under sections 47-A of the Excise Act. Near about 62 litres of country made Mahua liquor is said to have been recovered from the house of the petitioner. Admittedly, the petitioner was not present at the time of alleged recovery and he does not have any criminal antecedent which is evident from perusal of paragraph 3 of the bail application. Moreover, the petitioner is in jail custody since 22.02.2016.

Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount
