The petitioner is in custody in connection with Special Excise Case No. 1035 of 2019, arising out of K. Hat (Maranga) P.S. Case No. 924 of 2019, for the offence under Sections 272 and 273 of the Indian Penal Code and Section 30(a)of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.12.2019. He further submits that in the instant case total 116.250 litres of foreign liquor was seized. He further submits that nothing was recovered from exclusive possession of the petitioner.

Considering the fact that nothing was recovered from exclusive possession of the petitioner, the Court is inclined to

Patna High Court CR. MISC. No.3004 of 2020(3) dt.06-02-2020 2/2 grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Excise Act, Purnea in connection with Special Case No. 10503 of 2018, arising out of Digha P.S. Case No. 559 of 2018. In the event, the petitioner is found involved in similar case in future, the court below shall be at liberty to cancel his bail bonds in the present case.
