The petitioner seeks bail in Nasriganj P.S. Case No. 67 of 2014 registered under Section 304(B) and other Sections of the I.P.C. and 3⁄4 of the D. P. Act.

The father of the deceased made allegation that the petitioner and others burnt his daughter.

It is submitted that the occurrence took place on 09.05.2014 when the wife of the petitioner was alive but her statement was not recorded. During the course of investigation, the witnesses have stated that the victim herself set on fire. The petitioner is working in Delhi and he was not present in the house on the alleged date of occurrence.

No.8459 of 2015 (3) dt.22-05-2015 2 / 2 It appears that the petitioner is the husband and the father of the deceased made very specific allegation against the petitioner and others setting her on fire. The informant got her admitted in hospital where she died. The police after investigation submitted charge sheet only against the petitioner. Considering the facts aforesaid and the fact that the petitioner is the husband of the victim, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected in Nasriganj P.S. Case No. 67 of 2014, pending in the court of the learned S.D.J.M., Bikramganj, Rohtas at Sasaram. The Trial Court is directed to expedite the trial and conclude the same within nine months from the date of this order. U.K./- (Prabhat Kumar Jha, J) U T
