Earlier, the bail petition of petitioner was rejected, vide order dated 06.07.2021 passed in Cr.Misc. No. 17175/2021. On last occasion, vide order dated 23.03.2022, a report regarding stage of the trial was called for, which has been received and from perusal of the same, it appears that charge has already been framed on 06.01.2022 and out of 06 chargesheeted witnesses, 02 witnesses have already been examined It is submitted on behalf of petitioner that petitioner is in custody since 28.11.2020.
Considering the quantity of recovery of Smack, period of custody undergone by the petitioner and stage of the trial, the
Patna High Court CR. MISC. No.5090 of 2022(3) dt.27-04-2022 2/2 bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Gopalganj / concerned court in connection with Trial No. 25 of 2020, arising out of Gopalganj Town P.S. Case No. 667 of 2020.
