05.01.2015 Heard learned counsel for the Petitioner and the State.

The Petitioner seeks bail in Dhaka P.S. Case No. 36 of 2012 registered under Section 302/34 of the Indian Penal Code pending before the Sub-Divisional Judicial Magistrate, Sikrahana at Motihari, East Champaran.

Considering the direct allegation against the Petitioner in the First Information Report itself, I am not inclined to grant him bail. The prayer for bail is rejected. The Trial Court is directed to expedite the trial and for which reason he is directed to send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of this order, to the Superintendent of Police, East Champaran, and the Superintendent of Police, East Champaran is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
