JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-07-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Khagaria (Chitragupt Nagar) P.S. Case No. 717 of 2019, registered under Section 30(a) of the Bihar Excise Act. The accusation is that in course of patrolling duty, when the informant and other police personnel reached at Sanholi near power-greed then found some persons fleeing away from the bush. The local Chaukidar identified six persons named in the FIR including the petitioner. On search, 1162 pouches each containing 200 ml country made liquor recovered from the bush.
Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.3434 of 2020(2) dt.07-07-2020 2/2 petitioner has falsely been implicated in the present case due to dirty village politics and he is in custody since 08.11.2019. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cum-Special Judge (Excise), Khagaria, in connection with Khagaria (Chitragupt Nagar) P.S. Case No. 717 of 2019. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
