The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 409, 420, 379 and 120(B) of the Indian Penal Code read with Section 7 of the E.C. Act.
Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent, is aged about 70 years and allegation is of committing black marketing of food grains.
Learned counsel for the petitioner submits that the police after investigation have submitted final form in favor of the petitioner as would be evident from an Annexure - 3 to the
Patna High Court CR. MISC. No.5072 of 2022(2) dt.18-08-2022 2/2 anticipatory bail application but the learned trial court in a mechanical manner differing with the police report took cognizance of the offence.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Shakurabad P.S. Case No. 202 of 20219 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
