2. The petitioner is apprehending arrest in a case registered for the offences punishable in connection with Roh P.S. Case No.14 of 2021 under Sections 364, 365, 379/34 of the Indian Penal Code.

3. As per the prosecution, the FIR has been lodged against three unknown accused persons against whom there is allegation that they have snatched a mobile of the informant.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that He further submits that the petitioner's named has figured in this case by virtue of confessional statement of co-accused, namely, Vishnu Kumar. He further submits that the ptitioner has

Patna High Court CR. MISC. No.3893 of 2025(2) dt.12-02-2025 2/3 inimical term with the said Vishnu Kumar who himself involved in criminal activity and accused of Kashichak P.S. Case No.18 of 2021.

5. Learned Counsel further submits that the petitioner is actually residing with his family members in Maharashtra and since long working as Majdoor and by his Adhaar card, the organization, in which he is working, issued a certificate in this regard. He further submits that the Surpunch has also issued a certificate which is annexed as Annexure-2 of the bail petition.

6. Counsel further submits that only with a view to create pressure, his name has been inserted in this case and actually, he is victim in this case at the hand of the accused, Vishnu Kumar. He further submits that antecedent of the petitioner is clean.

7. Learned APP for the State opposes the prayer for bail and submits that though the petitioner is not named in the F.I.R. His name has been inserted by the co-accused during investigation.

8. In the present facts and circumstances, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Court below within a period of 4 weeks from today, on furnishing bail bonds of Rs.30,000/-
