JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-04-2019 The petitioner apprehends his arrest in connection with Gopalganj (Town) P.S.Case No. 234 of 2017 registered under Sections 363,366 and 366A/34 of the Indian penal Code. Allegation against the petitioner is of kidnapping the minor daughter of the informant.

Submission of learned counsel for the petitioner is that there was love affair in between them as she has got married with the petitioner and is residing with the petitioner however police has not got recorded her statement under Section 164 Cr.P.C Heard learned APP also who has opposed the prayer for anticipatory bail on the ground that up-till-now girl has not been recovered.

Having heard both sides and in view of the facts and

No.4451 of 2019(4) dt.04-04-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and if on that day, petitioner produces the girl, the court below shall examine about the statement of petitioner to her as to whether she has married with the petitioner and accordingly shall pass appropriate order, without being prejudiced by this order, if possible, on the same day.
