The petitioner seeks bail in anticipation of his arrest in connection with Andharamath P.S. Case No. 52 of 2020, dated 01.06.2020, instituted for the offences under Sections 341, 323, 324, 325, 307, 354, 379, 380, 448 and 504/34 of the Indian Penal Code.

The accusation against him and another is of assaulting the wife of the informant. The other accused

Patna High Court CR. MISC. No.15036 of 2021(2) dt.28-02-2022 2/3 persons are said to have assaulted the other members of the prosecution party. The persons who are said to have been assaulted in the occurrence have received only simple injuries.

There is a counter version of the occurrence also lodged by co-accused/Vijay Yadav @ Vijay Kumar Yadav against the informant of the present case and others vide Andharamath P.S. Case No. 51 of 2020 in which he has been granted anticipatory bail by a Bench of this Court vide order dated 24.11.2021 passed in Cr. Misc. No. 18547 of 2021.

Regard being had to the facts afore-stated and taking into account that the occurrence arose out of civil dispute between the parties, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Jhanjharpur, Madhubani in connection with Andharamath

Patna High Court CR. MISC. No.15036 of 2021(2) dt.28-02-2022 3/3 P.S. Case No. 52 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
