Heard learned counsel for the petitioner as well as learned APP through video conferencing.

Informant, father of deceased gave his Fardbeyan on 05.08.2019 disclosing therein that on 04.08.2019 at about 6:00 PM while she was engaged in cooking, received call on mobile, indulged in gossiping and during course thereof, proceeded towards an orchard lying east to her house. As she failed to return, all of them made hectic search and during course thereof, on 05.08.2019 at about 5:00 PM, they found her dead body in a sugarcane field having splash of acid. Furthermore, it is evident from the Fardbeyan itself, that suspicion has been shown against petitioner, Golu Ansari as well as Tunna Khan on account of

From perusal of the case diary, it is evident that a mobile set was found lying by the side of dead body which was seized (para-3 of the case diary). SIM having therein was in the name of one Jit Lal, would be father-in-law of the deceased. It is also evident that during course of investigation the call details were taken out and the most surprising feature is that there was no call received/dialed on 04.08.2019.

On that very score, Superintendent of Police, Bagha/West Champaran was show-caused over the manner of supervision having at his end and the show-cause is available on the record. Moreover, all the persons have shown suspicion, none had claimed to be eyewitness to the occurrence. In the aforesaid facts and circumstances of the case, let petitioner, Golu Ansari @ Reyaz @ Gollu Ansari be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Bagaha, West Champaran in connection with Ram Nagar PS Case No. 170/2019.
