The petitioner being the husband of the victim is languishing in custody since 31.12.2013 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The accusation is of killing the sister of the informant after eight years of the marriage. It is also alleged by the informant that earlier complaint case was filed with accusation under Section 498A IPC which ended into compromise. It is submitted by learned counsel for the petitioner that there is no direct evidence with regard to commission of the offence by the petitioner. The petitioner used to

Patna High Court Cr.Misc. No.15601 of 2015 (02) dt.20-05-2015 2/2 reside abroad and the money which was transmitted by this petitioner was used to be given by the victim to her brother-in-law and the trial has still not commenced and there is no likelihood of conclusion of trial in near future.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ad hoc Additional Sessions Judge-3, Siwan in connection with Sessions Trial No. 197 of 2014 arising out of Maharajganj (G.B.Nagar) P.S. Case No. 192 of 2011.
