====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 19-02-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Shahpur P.S. Case No. 536 of 2023 instituted under Sections 341, 323, 307, 379, 504, 506 and 34 of the Indian Penal Code.
3. As per the prosecution case, on 19.11.2023 at about 12:30 P.M. while the informant was ploughing his field the petitioner along with other co-accused persons came there and started assaulting him by stick and one Saddam Khan gave an iron rod blow on the informant's leg. As alleged, the petitioner also assaulted the informant's brother.
4. Learned counsel for the petitioner submits that petitioner is agnate of the informant and there is land dispute
Patna High Court CR. MISC. No.7473 of 2024(2) dt.19-02-2024 2/2 between the parties. The injury of the injured are simple in nature. Other co-accused namely Saddam Khan has been granted bail by a co-ordinate bench of this Court in Cr. Misc. No. 6103 of 2024 vide order dated 17.02.2024. Petitioner has one criminal antecedent in which he is on bail and the same was earlier filed by the informant side.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount to each to the satisfaction of the learned C.J.M., Bhojpur at Ara in connection with Shahpur P.S. Case No. 536 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973. (Sunil Dutta Mishra, J) anuradha/- U T
