JUSTICE AMARESH KUMAR LAL ORAL ORDER 20-05-2015 Since all these applications arise out of Moffasil P. S. Case no. 517 of 2014, they have been heard together and are being disposed of by this common order.
Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners seek bail in a case registered for the offence punishable under Sections 272, 273 and 290 of the Indian Penal Code and 47 (A) of the Excise Act. Allegation against the petitioners is that raid was conducted on secret information and it was found that illicit country made liquor was manufacturing and 50 litres of manufactured country made liquor was kept for
3 / 4 sale. The allegation against the petitioners, namely, Saroj Choudhary, Karu Choudhary and Ramawatar Choudhary is that they were the owners and others were working as labours in manufacturing country made liquor.
It is submitted that petitioners have no criminal antecedents except petitioner Karu Choudhary.
However, after investigation chargesheet has already been submitted against the petitioners.
Considering the facts and circumstances of this case, the above-named petitioners except petitioner Karu Choudhary ( of Cr. Misc. no. 16661 of 2015) are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in Moffasil P.S. Case No. 517 of 2014. The petitioner Karu Choudhary will be released on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the aforesaid Magistrate in connection with the aforesaid case after framing of charge. All the petitioners must follow the conditions mentioned below

1. One of the bailors will be the close relative of the petitioners.
2. The petitioners will not indulge in similar or in any other offence.
3. The petitioners will be well represented in the court.
4. In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bonds will be liable to be cancelled by the court concerned.
