JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.

Petitioner is named in the first information report with general allegation of assault along with other co-accused. The co-accused, Mohan Bind, who happens to be brother of the petitioner and in whose house it is alleged that deceased was killed, has already been granted privilege of bail by a co-ordinate Bench of this court and similarly, some other co-accused have also been released on bail by different Benches of this court. Petitioner is in jail custody since 29.02.2016 and does not have any criminal antecedent.

No.15976 of 2016 (2) dt.21-04-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 175 of 2015.
