JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in jail custody since 02-08-2014 in a case registered under Section-414 of the Indian Penal Code and Sections-25(i-b)A, 26/35 of the Arms Act. The petitioner was caught along with one loaded country-made pistol and one live cartridge and cash Rs 4,000/- was also recovered from his conscious possession. It would appear that according to prosecution case, the petitioner along with co-accused was caught by the police while he was fleeing after committing loot in a petrol pump but admittedly, the present case has not been lodged for committing the loot and for the offence of Arms Act, the petitioner has

Patna High Court Cr.Misc. No.13612 of 2015 (2) dt.20-05-2015 2/2 sufficiently been punished by remaining in jail custody for near about 10 months.

Considering the facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Siwan Muffasil P.S. Case No. 337 of 2014 corresponding to to the satisfaction of Learned Chief Judicial Magistrate, Siwan.
