JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-01-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as the learned APP for the State.

The petitioner apprehends his arrest in connection with Bihar P.S. Case No. 501 of 2017, registered for the offences punishable under Sections 366A/364 of the Indian Penal Code. The informant, Vinay Kumar Sinha, lodged the FIR mentioning therein that his daughter was student of class 9th in Good and Great Academy, co-accused Manish Kumar was also the student of the same academy. The daughter of the informant did not return to her house from the institution on the day of occurrence. The Director of the institution apprised the informant that his daughter was seen with co-accused Manish Kumar. The informant has expressed his

Learned counsel for the petitioner has submitted that the entire allegation is on Manish Kumar. The petitioner is not named in the FIR. He has also submitted that Annexure-2 is the statement of the victim under Section 164 of the Cr.P.C. In her statement also the victim has not named the petitioner rather she has named Randhir Kumar who took the victim on his motorcycle.

Considering the above-mentioned facts and circumstances, let the petitioner be released on bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Biharsharif in connection with Bihar P.S. Case No. 501 of 2017, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey , J) SONALI/- U T
