The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 379, 354(B), 504 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent. Learned counsel for the petitioner after arguing vehemently for sometime, seeks permission to withdraw the anticipatory bail application with respect to petitioner No. 1, Jamdar Rai.

Permission is accorded.

It is next submitted that the informant alleges that Jaipal Rai, petitioner No. 2 along with Ganesh Rai assaulted

Patna High Court CR. MISC. No.5187 of 2022(6) dt.22-06-2023 2/2 informant's sister-in-law with the backside of the kudal and iron rod respectively and further snatched the gold chain from her. It is next submitted that the petitioner and the informant are neighbors and on account of a trivial dispute, the occurrence is said to have taken place.

Learned A.P.P. for the State along with the learned counsel for the informant opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Garkha P.S. Case No. 361 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
