2. This is the third regular bail application on behalf of the petitioner in connection with Ghoswari P.S. Case No. 81 of 2022 registered for the offence under Sections 392, 411 of the Indian Penal Code.
3. The petitioner is accused of committing loot. He is in custody since 19.02.2024.
4. Learned counsel for the petitioner has submitted that the petitioner is ready to make good part of loss to the informant and undertakes to pay Rs. 25,000/- (Rupees Twenty Five Thousand) to the informant by way of demand draft without prejudice to his case and without accepting his guilty.
5. Considering the undertaking given by the petitioner
Patna High Court CR. MISC. No.7019 of 2025(2) dt.05-03-2025 2/2 and also considering the period of custody, this application is allowed.
6. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C., Barh, Patna/concerned Court below in connection with Ghoswari P.S. Case No. 81 of 2022 subject to condition that:- (I). At the time of furnishing the bail bonds, the petitioner shall furnish a demand draft of Rs. 25,000/- prepared in the name of the informant. If the petitioner furnishes the aforesaid demand draft prepared in the name of the informant, the Court below shall accept the bail bonds of the petitioner and the demand draft shall be released in favour of the informant.
