JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-05-2016 Heard learned counsels for the petitioner and learned APP for the State.

The petitioner is languishing in custody since 08.12.2015 in a case registered for the offences punishable under sections 22,24 and 29 of the NDPS Act, in connection with Kursa Kanta P.S. Case No.150/2015 (Special Case No.19/2015), pending before the learned Special Judge, Araria. The petitioner was intercepted by the SSB while entering into the Indian territory from Nepal when from the possession of the petitioner 900 gram Tiger brand Heroine contained in two packets were recovered.

It is submitted by learned counsel for the petitioner that the petitioner has no criminal antecedent

Patna High Court Cr.Misc. No.16203 of 2016 (2) dt.18-05-2016 2/2 Considering the commercial quantity of recovery, this court is not inclined to grant bail to the petitioner at present. Accordingly, the prayer for bail on behalf of the petitioner is rejected.
