The petitioner is in custody in connection with Maharajganj P.S. Case No. 128 of 2016 corresponding to CIS Registration No. 951 of 2018 for the offences under Section 394 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 23.10.2018. He further submits that petitioner was not named in the F.I.R. His name surfaced on the confessional statement of co-accused Tusar Kumar Singh.

Learned counsel for the petitioner submit that the till date petitioner has not been put on TIP and the co-accused has

Patna High Court Cr.Misc. No.3065 of 2019(2) dt.23-01-2019 2/2 been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 14879 of 2017 vide order dated 12.05.2017. Considering the aforesaid, the Court is inclined to grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Chief Judicial Magistrate, Siwan in connection with Maharajganj P.S. Case No. 128 of 2016 corresponding to CIS Registration No. 951 of 2018.
