The petitioner is languishing in custody since 19.11.2014 in a case registered for the offences punishable under Section 394 of the Indian Penal Code.

Informant's cash of rupees seven lakhs was robbed leading to the registration of the FIR against unknown. The name of the petitioner sprang up on the confession of Md. Sakil and Pinku Sah and they have been granted bail vide Cr. Misc. No. 49236 of 2013.

Statements have been made in paragraph nos.

10 and 11 of the petition that neither there is any recovery from the petitioner nor the petitioner has been put on TIP.

No.24510 of 2015 (2) dt.21-07-2015 2/2 Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned IInd Additional Sessions Judge, Naugachia in the district of Bhagalpur in connection with Sessions Trial No. 171 of 2014 arising out of Bihpur P.S. Case No. 280 of 2013.

Since the petitioner has serious criminal antecedent, the learned court below will be at liberty to cancel the bail bonds of the petitioner in two eventualities i.e. if he defaults for two consecutive occasions or substantially gets involved in some serious nature of offence.
