ANJANA PRAKASH ORAL ORDER 27-04-2016 Heard learned Counsel for the petitioner and the State. The Petitioner was allowed bail by the order dated 7.10.2010 passed by this in Cr. Misc. No. 33847 of 2010, but, the Court below has cancelled his bail bond on the ground of misuse of privilege of bail.

Considering that the Petitioner is in custody since 21.3.2016 and undertakes to be physically present on each date of Trial, let the petitioner above named, be released on bail on furnishing bail bond of Rs.5,000/-(Five thousand) with two sureties of the like amount each or any other surety to be fixed by the court concerned to the satisfaction of A.D.J. IV, Nawada, in connection with Sessions Trial No. 53 of 2010/335 of 2014 arising out of Kawakol P.S. Case No. 52 of 2010, subject to the

Patna High Court Cr.Misc. No.16738 of 2016 (2) dt.27-04-2016 2/2 conditions, (i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner. (ii) That the Petitioner will be physically present on each date of Trial and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.

However, the Court below is directed to conclude the Trial positively within a period of four months from the date of receipt of this order without granting unnecessary adjournment to any Party.
