JUSTICE SANJAY PRIYA ORAL ORDER 02-04-2019 Heard learned counsel for the petitioner, learned counsel for the informant and the learned APP for the State. The petitioner seeks bail in Ladania P. S. Case No. 124 of 2018 instituted for the offence under Section(s) 406 and 420 of the Indian Penal Code.
In the written report, it is alleged that this petitioner took an amount of Rs. 2,98,000/- from the informant on the pretext of getting her job in the Bihar Police, but he did not get job. The petitioner has misappropriated the amount. A panchayati was held where the petitioner has accepted of having received the aforesaid amount. He assured to return the amount to the informant by 31.6.2017.
During hearing of the bail petition, the original paper
Patna High Court CR. MISC. No.3148 of 2019(5) dt.02-04-2019 2/3 of the Panchayati has been produced by the informant-opposite party no.2 before this Court. The photo copy of the aforesaid document shall be kept on record.
Learned counsel for petitioner submits that he is ready to make payment of the amount of Rs. 2,98,000/- to the informant- opposite party no.2 in equal installments subject to final decision of the case.
Considering the aforesaid, let the petitioner, above named, be released on provisional bail for a period of six months from the date of his release on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-IV, Madhubani, in connection with Ladania P. S. Case No. 124 of 2018, corresponding to CRI case no. 1138 of 2018, subject to the condition that both the bailors shall be the close relative of the petitioner.
It is made clear that petitioner will file affidavit at the time of filing of his bail bond that he will make payment of Rs. 2,98,000/- in six equal installments to the informant-opposite party no.2. The Court below shall confirm the provisional bail of the petitioner after six months in the event he make payment of Rs. 2,98,000/- to informant in equal installment within
