JUSTICE SUDHIR SINGH ORAL ORDER 12-08-2015 The petitioner is languishing in custody since 24.11.2011 in connection with S.Tr. No.218/12 arising out of Dawath P.S. Case No.80 of 2011 for the offences instituted under Sections 364(A), 120(B), 419, 420 of the I.P.C. and 302 of I.P.C. was added later on.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the husband of the informant, namely, Vinod Choudhary, and accused persons including the petitioner were involved in mobile tower installation work in Ballia where on account of money transaction he was killed by them and his dead body was thrown by the side of the Road.

Patna High Court Cr.Misc. No.24516 of 2015 (3) dt.12-08-2015 2/2 It has been submitted on behalf of the petitioner that the bail application of the petitioner has been twice rejected by this Court. The present application for bail has been filed in third attempt. As per the report regarding the stage of the trial called for as many as five witnesses have already been examined in the present case.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. Same is rejected.

Any how the trial court is directed to take all steps to conclude the trial within a period of six months from the date of receipt/production of a copy of this order on day to day basis avoiding undue delay and adjournments.
