Petitioner seeks regular bail in a case registered for the offence punishable under Section 302, 328, 120(B) of the Indian Penal Code.

As per the prosecution case, all the FIR named accused persons, including this petitioner, killed the sister of informant by poisoning.

It is submitted on behalf of petitioner that informant is not an eye witness of the occurrence and petitioner has falsely been implicated in the case only because she is first wife of husband of deceased and during investigation, not an iota of evidence has come against her. Allegations are general and omnibus in nature and is based upon suspicion. Petitioner is in custody since 26.10.2021. Investigation is completed.

Patna High Court CR. MISC. No.5182 of 2022(2) dt.12-05-2022 2/2 Learned A.P.P. for the State opposed the prayer for bail.

Considering the aforesaid facts and circumstances as well as period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Singheshwar PS case No.253/2020.
