JUSTICE PRABHAT KUMAR JHA ORAL ORDER 17-08-2015 Heard the learned counsel for the petitioner, the learned counsel for the informant and the learned Additional Public Prosecutor.

The petitioner seeks bail in a case under Section 366A/34 of the Indian Penal Code.

The informant, father of the victim, made allegation that Md. Taj enticed his minor daughter.

It is submitted that petitioner is mother of Md. Taj. Only allegation against the petitioner is that when the informant went to the house of petitioner to enquire about his daughter the petitioner and other family members are alleged to have abused him. It is submitted that earlier also the victim had fled away with

On the other hand, the learned counsel for the informant has submitted that the victim is still traceless and informant has got every suspicion that the petitioner and others might have killed her.

Considering the fact that petitioner is not alleged to have kidnapped the victim girl and she is a lady, mother of Md. Taj, who is alleged to have kidnapped the victim, and she is in jail since 26.02.2015, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in Motihari Town P.S. Case No. 574/ 2014 (G. R. No 4205/2014).
