2. The present application has been filed against the order dated 13.12.2023 passed in A.B.P. No.-1698/2023 by the Additional District & Sessions Judge III, Buxar in connection with Brahampur (Chakki O.P.) P.S. Case No. 689/23 under Section 135 of the Electricity Act- 2003 by which the petitioner has been granted Anticipatory bail by the court below with a condition that petitioner shall deposit the whole amount i.e., Rs. 2,20,240/loss caused to the revenue of the Electricity Department, at the time of furnishing bail bond.

3. The limited prayer of the petitioner is that he is ready to deposit the amount of Rs. 2,20,240/-, but because of his financial condition, he prays that he will pay the same to the opposite party No. 2 in eight equal installments.

4. Mr. Ojha, learned counsel appearing for the opposite party No. 2 has no objection to this.

5. In these circumstances, this application is allowed.

6. The petitioner is directed to deposit the amount of Rs. 2,20,240/- in eight equal installments.

7. The order dated 13.12.2023 passed by the Additional District and Sessions Judge, III, Buxar in A.B.P. No. 1698 of 2023 is modified to the extent indicated above. (Sandeep Kumar, J) Saif/- U T
