In this case, the petitioner is seeking anticipatory bail in connection with Maheshkhunt P.S. Case No.142 of 2019 registered for offence punishable under sections 147, 148, 149, 341, 323, 307, 379, 447 and 504 of the Indian Penal Code. Allegation has been made that the accused persons barged in the shop, thereafter, they started looting the money of informant and when the resistance was made, the present petitioner assaulted the informant by butt of gun. The learned counsel for the petitioner submits that the petitioner's father died at the earlier stage and to resist his uncle, he has gone rough. Looking to the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders before the court below within three weeks from today and prays for regular bail, the court below without being prejudiced by this order will take decision in accordance with law.
