Allegedly, petitioner was caught on the spot but submission on behalf of the petitioner is that petitioner is old friend of informant's brother and as a matter of fact, there was differences between the informant and his brother and being friend of informant's brother, petitioner intervened into the differences of the informant and his brother and tried to pacify the matter, which caused annoyance to informant and thereafter, petitioner has been made accused. Case No. 35 of 2015 to the satisfaction of Sri S. K. Srivastava, Judicial Magistrate, Raxaul, East Champaran at Motihari.
