JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-387/34 of the Indian Penal Code.

No doubt, petitioner carries criminal antecedent of several cases but submission on behalf of petitioner is that the informant had given written petition before the Superintendent of Police, Gopalganj for retention of his bodyguard and in the aforesaid written petition, he disclosed that FIR named accused Manindra Mishra had demanded extortion money some days ago and he might be killed by aforesaid Manindra Mishra as well as the petitioner.

Learned counsel for the petitioner points out that on

Patna High Court Cr.Misc. No.16022 of 2016 (2) dt.21-04-2016 2/2 the basis of aforesaid written petition, the police instituted the present case against the petitioner.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Gopalganj (Town) P.S. Case No. 393 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Gopalganj. (Hemant Kumar Srivastava, J) A.K.V./- U T
