The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The informant named nine persons in the FIR and alleged that on information when he went to the medical shop Dhruv Sah and Ravi Kumar assaulted his son with iron rod and his son Jawed Akhtar fell down. Other accused persons are alleged to have assaulted Suraj Kumar, Ashish Kumar Upadhayay and Sheikh Shahid.

Submission is that the petitioner is not the assailant of the deceased Jawed Akhtar. There is no injury report of other injured. Similarly situated co-accused Munna Prasad has already been

Patna High Court Cr.Misc. No.25280 of 2015 (3) dt.04-08-2015 2/2 enlarged on bail vide orders passed in Cr. Misc. No. 17017 of 2015. Considering the facts aforesaid and the fact that the petitioner is not the assailant of the Jawed Akhtar, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in Shikarpur P.S. Case No. 89 of 2015.
