The petitioners are languishing in custody since 25.08.2014 in a case registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

Subsequently, sections 328 and 120B of the Indian Penal Code. The prosecution case is that the informant's nephew Chhote Pandit went to her in-laws on 30.03.2013 to bring back his wife and on 31.03.2013 the informant received information on mobile that his nephew has consumed poison and the informant went there and came to know through cousin sister

Patna High Court Cr.Misc. No.25665 of 2015 (2) dt.23-07-2015 2/2 aged about six years that the in-laws administered poison to Chhote Pandit then the informant came to the cremation ground but he did not find the dead body.

It is submitted by learned counsel for the petitioners that no resisting injury has been found on the dead body of the victim and only on suspicion the accusation has been levelled. Moreover, the investigation has already concluded. Considering the fact that the informant is not the eye witness to the occurrence, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-X, Muzaffarpur in connection with Sessions Trial No. 938 of 2014 arising out of Katra P.S. Case No. 57 of 2013.
